Terms of service

1. Scope

These terms govern the use of Tradebell (website and web application) between the provider named below and you as a user. Deviating terms only apply if we expressly agree to them.

2. Service

Tradebell is software for documenting and analysing your own trades (a trading journal). There is a free version (Free) and a paid subscription (Pro); the features of each are described on the pricing page.

• Not investment advice: Tradebell does not recommend buying or selling financial instruments. Metrics, hints and analyses are for your own analysis only.
• Imported data comes from your files or your broker. We aim for correct calculations but do not guarantee completeness or accuracy – your broker's statements always prevail.
• We aim for high availability but cannot guarantee uninterrupted access (e.g. maintenance or third-party outages).
• We may further develop the service and change features as long as the agreed core of the service remains.

3. Account

• You need an account. You must be at least 18 years old and provide truthful information.
• Keep your credentials secret. Only connect broker accounts you are authorised to use.
• You must not misuse the service (e.g. attacks, automated bulk requests, infringing third-party rights).

4. Pro subscription, prices and payment

• The prices shown on the pricing page at the time of purchase apply. For consumers they are final prices including any applicable VAT.
• The subscription runs monthly or yearly and renews automatically for the chosen term unless cancelled before.
• You can cancel anytime effective at the end of the current term – with one click in the customer portal under “Subscription & billing”. Pro stays active until then.
• Payment is made in advance via our payment provider Stripe. If a payment fails, Pro features may be locked after the term ends; your data is kept.
• We announce price changes for running subscriptions at least 30 days in advance; you can cancel before they take effect.

5. Right of withdrawal for consumers

If you are a consumer, you can withdraw from a Pro subscription within 14 days of conclusion without giving reasons. An informal email to the address below is enough.

If you expressly request that we start the service before the withdrawal period ends, you pay an amount proportional to the service provided until withdrawal (§ 16 FAGG). Otherwise we refund payments within 14 days using the original payment method.

6. Your data

Your trading data belongs to you. You can export it and delete your account with all data at any time (Settings → “Data and account”). A running Pro subscription ends immediately on deletion. See the privacy policy for details.

7. Liability

• We are liable without limitation for intent and gross negligence and for personal injury.
• For slight negligence we are not liable, as far as legally permitted. For consumers, liability for personal injury and damage to items taken into our care remains unaffected.
• We are not liable for trading decisions you make based on analyses in the app, or their outcomes.

8. Termination by us

We may suspend or terminate an account for serious or repeated violations of these terms. Paid subscription periods that can no longer be used are refunded pro rata, except in cases of abuse.

9. Changes to these terms

We inform you at least 30 days before changes by email or in the app. If you don't object before they take effect, the new terms apply; we point this out in the notice. If you object, you may cancel.

10. Governing law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory protection rules of their country of habitual residence remain unaffected. For businesses, the place of jurisdiction is the provider's registered office.
